1. About ASTA

ASTA is a circular platform for pre-owned clothing.

ASTA is not a traditional marketplace where users buy and sell clothing directly from one another. Instead, users participate in ASTA’s circular clothing universe by contributing clothing to ASTA and using credits to receive other pre-owned clothing available through the platform.

All clothing must pass through ASTA before being made available to another user.

The flow is therefore:

User → ASTA → User

ASTA handles the receipt, assessment, processing and redistribution of clothing through the platform.

2. Membership and access to ASTA

Access to ASTA may require payment of a subscription fee, membership fee or another access fee depending on the membership or service offered at the relevant time.

The applicable price and payment terms will be displayed before the user signs up or completes payment.

If a recurring subscription is offered, it will be clearly stated that the payment is recurring, together with the applicable price and billing interval. Danish consumer rules require subscription terms and payment obligations to be presented clearly before an online agreement is entered into. 

ASTA may offer different membership types, prices, benefits or access levels from time to time.

3. User account

Users may be required to create a personal account in order to use ASTA.

Users are responsible for ensuring that the information associated with their account is correct and up to date.

An account is personal and may not be transferred to another person without ASTA’s consent.

Users must keep their login information confidential and are responsible for activity carried out through their account.

4. Users under the age of 18

Users under the age of 18 may use ASTA to the extent permitted under Danish law.

Where consent from a parent or legal guardian is required under applicable law, the user is responsible for obtaining such consent before entering into an agreement with ASTA or making payments through the platform.

5. Credits

ASTA uses an internal credit system.

Clothing available through ASTA is assigned a value in credits rather than being offered as a traditional sale between users.

Credits may be earned when a user submits clothing that is accepted by ASTA.

The number of credits awarded may depend on factors including:

  • the condition of the item;
  • brand;
  • quality;
  • type and category of clothing;
  • demand and relevance within ASTA;
  • whether the item is clean and properly prepared; and
  • ASTA’s overall assessment of the item.

ASTA determines the credit value of submitted clothing.

6. Nature of credits

Credits are intended for use within the ASTA platform.

Credits do not constitute legal tender and cannot be used as currency outside ASTA.

Unless otherwise expressly stated by ASTA or required by mandatory law, credits cannot be exchanged for cash or transferred to another user.

Credits may only be used in accordance with the rules applicable to ASTA at the relevant time.

7. Uploading and submitting clothing

Users may submit clothing to ASTA through the procedures made available on the platform.

Uploading an item does not in itself guarantee that the item will be accepted.

ASTA may assess the clothing based on, among other things:

  • condition;
  • cleanliness;
  • quality;
  • brand;
  • category;
  • style;
  • demand; and
  • suitability for ASTA’s universe.

ASTA reserves the right to reject items that do not meet ASTA’s acceptance criteria.

The applicable credit value is determined by ASTA once the item has been assessed.

8. Ownership of clothing submitted to ASTA

When a user physically hands over or otherwise delivers an item to ASTA and the item is accepted by ASTA, ownership of the item transfers to This is ASTA ApS.

From that point, the previous owner no longer has ownership rights to the individual item.

In return, the user receives the number of credits allocated to the item by ASTA.

ASTA may subsequently make the item available to another user through the platform.

9. Receiving clothing from ASTA

Users can use credits to obtain clothing made available through ASTA.

The number of credits required for an item is displayed on the platform before the user confirms the transaction.

When an item has been transferred to and received by the user, ownership of the clothing transfers from ASTA to the receiving user, subject to any applicable statutory withdrawal rights.

ASTA therefore owns the clothing while it is within ASTA’s circulation and until ownership is transferred to the new user.

10. 14-day return and withdrawal period

If a user receives an item through ASTA and does not wish to keep it, the user may return the item to ASTA within 14 days of receipt, subject to these Terms and applicable Danish consumer law.

As a general rule, consumers have a 14-day right of withdrawal when entering into agreements for goods online. 

Once ASTA has received and approved the returned item, the user will receive the same number of credits that were used to obtain the item.

Credits will normally be returned to the user’s ASTA account rather than paid out in cash.

The item must be returned in substantially the same condition as when received, apart from handling reasonably necessary to inspect the item.

11. Pre-owned clothing

All or substantially all clothing circulated through ASTA is pre-owned.

Users therefore accept that clothing may show ordinary signs of previous use and wear that can reasonably be expected from pre-owned clothing.

The fact that an item has previously been used does not in itself constitute a defect.

Nothing in these Terms limits statutory consumer rights that cannot legally be waived. Danish consumer purchases are generally subject to mandatory rules concerning defects and complaints. 

12. Cleaning and condition of submitted items

Items submitted to ASTA must be clean and suitable for circulation.

ASTA may reject clothing that is, for example:

  • excessively worn;
  • damaged;
  • dirty;
  • unhygienic;
  • counterfeit;
  • unsuitable for resale or redistribution; or
  • otherwise inconsistent with ASTA’s current acceptance criteria.

ASTA may update its acceptance criteria from time to time.

13. Counterfeit items and ownership

Users may only submit clothing that they are legally entitled to transfer to ASTA.

By submitting an item, the user confirms that:

  • the user owns the item or otherwise has the legal right to transfer it;
  • the item is not stolen;
  • the item is not counterfeit; and
  • transferring the item does not infringe third-party rights.

ASTA may reject or remove an item if ASTA reasonably suspects that these requirements are not satisfied.

14. Prices and payments

Any subscription fees, membership fees, service fees or other amounts payable to ASTA will be displayed in Danish kroner (DKK) unless otherwise stated.

Clothing within ASTA’s circular system is valued in credits.

Where a monetary payment is required, the total price and applicable payment terms will be shown before the user confirms the payment.

15. Subscriptions

Where ASTA offers a recurring subscription, information about the price, payment interval and conditions for cancellation will be displayed when the subscription is created.

Online subscriptions are generally subject to a 14-day statutory withdrawal period under Danish consumer law. 

If the user expressly requests that the service begins during the withdrawal period, the consequences of doing so will be handled in accordance with applicable Danish consumer legislation.

Users can cancel a subscription in accordance with the cancellation procedure stated on the platform and applicable mandatory law.

16. Changes to prices, credits and the ASTA model

ASTA may develop and change its platform over time.

This may include changes to:

  • membership prices;
  • subscription models;
  • service fees;
  • the number of credits awarded for clothing;
  • the number of credits required for particular items;
  • acceptance criteria;
  • membership benefits; and
  • functionality of the platform.

Changes will apply prospectively and will not remove rights already acquired by users where doing so would conflict with mandatory law.

Material changes affecting an ongoing paid subscription will be communicated in accordance with applicable law.

17. Availability

ASTA cannot guarantee that specific brands, sizes, styles or categories of clothing will always be available.

The selection depends on clothing currently circulating through ASTA.

Items may become unavailable at any time.

18. Delivery and collection

ASTA may offer one or more methods for delivering or collecting clothing.

Available methods, locations, delivery charges and expected delivery times will be displayed through the platform where applicable.

Users are responsible for providing accurate delivery and contact information.

19. Complaints

If a user experiences a problem with an item or with ASTA’s service, the user should contact:

The user should provide sufficient information for ASTA to identify the relevant account, transaction and item.

Nothing in these Terms limits rights available to consumers under mandatory Danish consumer legislation.

20. Misuse of ASTA

ASTA may suspend or terminate an account in cases of material or repeated misuse of the platform.

Misuse may include, for example:

  • submitting counterfeit or stolen clothing;
  • deliberately providing incorrect information;
  • manipulating ASTA’s credit system;
  • creating multiple accounts to obtain improper benefits;
  • fraud;
  • abuse of other users or ASTA employees; or
  • other conduct materially contrary to these Terms or applicable law.

Any suspension or termination will take into account applicable consumer rights and the circumstances of the individual case.

21. Intellectual property

ASTA’s name, trademarks, design, images, software, texts and other platform content are owned by or licensed to This is ASTA ApS unless otherwise stated.

Users may not copy, reproduce or commercially exploit ASTA content without permission, except where permitted by law.

22. Personal data

ASTA processes personal data in accordance with applicable data protection legislation and ASTA’s Privacy Policy.

The Privacy Policy is made available separately on the platform.

23. Liability

ASTA is liable in accordance with the general rules of Danish law.

Nothing in these Terms excludes or limits liability or consumer rights where such exclusion or limitation would be unlawful.

ASTA is not responsible for temporary interruptions or unavailability caused by circumstances outside ASTA’s reasonable control.

24. Changes to these Terms

ASTA may update these Terms where reasonably necessary, for example due to:

  • changes to the ASTA service;
  • new functionality;
  • changes in legislation;
  • regulatory requirements; or
  • operational changes.

The current version will always be available through ASTA’s platform.

Material changes affecting existing users will be communicated where required by law.

25. Governing law

These Terms and any agreement between the user and This is ASTA ApS are governed by Danish law, subject to mandatory consumer protection rules that may apply.

Any dispute shall be handled by the competent Danish courts unless mandatory law provides the consumer with another right to bring proceedings.
